Man pictured on Nirvana’s “Nevermind” Cover is suing the band
The suit alleges Child Pornography
Spencer Elden, the man whose infamous baby photo was used for one of the most recognizable album covers of all time, Nirvana’s “Nevermind,” filed a lawsuit yesterday alleging that the nude image constituted child pornography.
The album cover depicts him as a baby underwater in a swimming pool as a then-infant with his genitalia exposed. Elden is seeking $150,000 in damages from each of the 15 defendants named, which include Nirvana, Warner Records, Universal Records, Dave Grohl, Krist Novoselic, Courtney Love (as the executor of Kurt Cobain’s estate), Guy Oseary and Heather Parry (as managers of Cobain’s estate).
Elden’s lawyer claimed he has suffered and will continue to suffer lifelong damages because of the album cover.
The filing claims Elden and his parents did not sign a release allowing the images to be used.
