Description of Promotion/Participation

X1039, Revolution Jewelry Works, and Bazinga Vintage Toys and Collectibles, and Metronet may be referred to as “The Sponsor(s)” from this point forward.

Dates of Promotion: The promotion begins on 02/10/2025 and ends on 03/10/2025

How to Enter: No Purchase Necessary

1. X1039 will promote the giveaway through live liner reads, recorded promos and social media pages.
2. X1039 Mornings will announce the “Gold Artist Of The Day” at 7:30 AM Monday – Friday. A daily “keyword” will be given out at that time. The daily “keyword” will be announced multiple times per day.
3. Listeners will have to text the daily “keyword” to (719)-219-7625 in order to be entered to qualify for the final giveaway. Five (5) qualifiers will be chosen each day to advance to the final round.
4. Participants may only qualify once.
5. Final determination of winner: X1039 will randomly select a name from the list of qualifiers at the end of the promotion (03/10/2025) and announce that name on the air during the X1039 Morning Show on Monday, March 10, 2025. Winner does not need to be listening to win. Entries must be made by end of business on 3/7/2025 (5p MST.)
6. One Grand Prize: One winner will win the “golden sign-up pad” with 50 (fifty) entries, to be able to be used how the winner sees fit. Entries can be placed in any concert/event box X1039 brings to live on-site events throughout 2025. The “golden sign-up pad” sheets can be blown all on one box or used throughout the year sparingly. This doesn’t guarantee a win, but it can increase your odds drastically!

Not to be exchanged for other prizing, or cash. User can only register on-site for event tickets only. No on-air giveaways qualify for use of the golden registration pad. User cannot use the golden registration pad to sign up for events where there are other finalists, (ie. flyaways, cash giveaways, etc.) The golden registration pad entry sheets are only good for concerts, or other ticketed events promoted in 2025. Registration pad does not put the user in the final round. ALL entries received in person are random, and the golden registration pad does not guarantee a win. Chances of winning depend on the number of entries received.

Eligibility and Limitations. All winners of the contest must be at least eighteen (18) years of age or older. Winner must provide X1039 with his or her social security number, complete a W-9 form, and must sign an Affidavit of Eligibility and a Release and Waiver from all liability against X1039, its sponsors, employees and affiliated companies for any injury or loss which may occur from the contestant’s participation in the contest or from use of any prize which is awarded. One winner per household per thirty days. Employees of The Sponsors, the Promotion’s participating sponsors and their advertising agencies, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, whether as “in-laws” or by current or past marriage(s), remarriage(s), adoption, cohabitation or other family extension, and any other persons residing at the same household whether or not related.
Entry: No purchase necessary. Participants must text the studio text line at (719)-219-7625 to be eligible to win. For text message based contests: In case of an identity dispute, the registered user of the text message account on the date of entry will be the recognized user. Participants acknowledge that messages are distributed via third party mobile network providers and, therefore, Station cannot control certain factors relating to message delivery. Participants acknowledge that, depending on the recipient’s mobile provider service, it may not be possible to transmit the message to the recipient successfully. Station does not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures. Station does not charge a fee for this service. It is each Participant’s responsibility to check with their individual carrier, as other charges may apply. BE ADVISED THAT IN SOME CASES, TEXTS TO THE STATION WILL RESULT IN ONE OR MORE AUTOMATIC BOUNCE BACK MESSAGES, FOR WHICH PARTICIPANTS MAY INCUR A FEE FROM THEIR PROVIDER. Station assumes no responsibility for charges incurred for text-messaging, including, without limitation, as a result of any bounce back messages or contest notices from the Station. To win, listeners must qualify Monday-Friday during the week. The winner’s name will be announced during the X1039 Morning Show. Winner does not need to be listening to win.
Publicity; Privacy. By participating, all participants and winner(s) grant The Sponsors and its promotional partners exclusive permission to use their names, characters, photographs, voices and likenesses in connection with promotion of this and other Promotions and waive any claims to royalty, right or remuneration for such use. By participating in the Promotion, participants agree that The Sponsors may disclose personal information obtained from participants in the Promotion to third parties and use such information for marketing and other purposes.
Release. By participating, each participant and winner waives any and all claims of liability against The Sponsors, their employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the promotion, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the sponsors.
Rules. Additions or deletions to these rules are subject to the discretion of the sponsors, and may be enacted without notice at any time during the promotion dates.
1. If the winner is unable to meet the above criteria stated in rules 6-9, then he or she will become ineligible to qualify or win the grand prize and a runner-up will be selected.
2. The winner will forfeit all prizes not claimed within thirty (30) days.
Taxes. Any valuation of the prize(s) stated above is based on available information provided to the sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All federal/state/local taxes are the winner’s sole responsibility. Insurance coverage, registration and title transfer fee are also the winner’s sole responsibility. Winners must provide the sponsors with valid identification and a valid social security number before any prize will be awarded. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
X1039 will not be responsible for prizes not delivered by participating clients as a result of “going out of business” or any other reason.
Decisions. By participating in the promotion, participants agree to be bound by the decisions of the sponsors. The sponsors reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible, violated any rule or provided false information. If the conduct or outcome of the promotion is affected by human error, any mechanical or technical errors, malfunctions or failures of any kind, or any event beyond the control of the sponsors. The sponsors reserves the right to terminate this promotion or make such other decisions regarding the outcome as the sponsors deems appropriate. All decisions will be made by the sponsors and are final.
Miscellaneous. Each winner must submit proof of eligibility and sign The Sponsor’s release form to claim the prize. No purchase necessary to participate or win. Void where prohibited. The Sponsors disclaims any responsibility to notify participants of any aspect related to the conduct of the Promotion.
