X1039’s X MARKS THE SPOT OFFICIAL CONTEST RULES

WIN CASH, CONCERT TICKETS, AND LOCAL PRIZE GIVEAWAYS ALL SUMMER LONG!

June 2, 2025

  1. X1039,  IVP At The Beach House, and Rick’s Garden Center may be referred to as “The Sponsors” from this point forward.
  2. Dates of Promotion: The Promotion begins on 06/02/2025 and ends on 08/23/2025
  3. How to Enter: No Purchase Necessary. Contest will have many winners.
  4. X1039 will promote the event through live liner reads, recorded promos and social media pages.
  5. For listeners to get entered, they must listen for the “X Marks The Spot” cue to call and be caller number 10 (ten) to qualify weekdays between 7:35-7:48 a.m., 11:30 a.m., and 3:30 p.m. Once qualified, the listener will pick between 3 (three) “treasure chests” (1, 2 or 3). These “treasure chests” will be filled with either  a prize from a local business (I Heart Mac and Cheese, Pikes Peak International Raceway, Rocky Mountain Vibes Baseball, Colorado Renaissance Festival, Wishing Star Farm, or Smooth Alpaca Experience,) a small ticket concert, “xtra” entries, or it could be empty. Listeners will not know what is in any of the chests when picking. It will all be random. 
  6. Listeners will also have “Xtra” chances to qualify by visiting our local sponsors around town and looking for the “X Marks The Spot” poster at the sponsor location. The “X Marks The Spot” poster will have a special QR code to sign up for another entry into the grand prizes! This treasure map will be located on the X Marks The Spot webpage at x1039radio.com. Listeners can only enter once per location per day of the current round. Xtra entries must be submitted by close of business the Friday before each monthly giveaway: 6/28, 7/26, and 8/23. Maximum of 10 entries per round. The contest will restart for the next round, and contestants will have to re-qualify each round.
  7. Final determination of winners: 201 (two-hundred-and-one) winners total.
  8. On the air: On-air winners will be determined by being caller #10 randomly daily during the Morning Drive (7:30a.m.,) X1039 Mid-days (11:30a.m.,) and the Afternoon Drive (3:30p.m.,) weekdays starting Monday, June 2, 2025 and ending on Friday, August 22, 2024. On-air winners will win either  a prize from a local business or a pair of tickets to a small concert. The on-air winners’ names will be entered to win the monthly prize on location at the end of each month. See below.
  9. At the end of each month: On Saturday, June 28, 2025 1p.m.-3p.m., Saturday July 26, 2025 1p.m.-3p.m., and  Saturday, August 23, 2025 1p.m.-3p.m., all qualifiers will meet on location at IVP At The Beach House (5910 Omaha Blvd, Colorado Springs, CO 80915) for a chance at the monthly “Grand Prize” which will be a pair of tickets to a big concert, and cash. There will be two concerts to choose from. The Grand Prize winner takes their pick of tickets plus the big cash up for grabs. The runner-up at these live-location events will receive whichever tickets the Grand Prize winner does not pick, and $100 cash. There will be 3 (three) total grand prize winners and 3 (three) total Runner-Up winners at the end of the contest.
  10. On location at IVP at The Beach House: On Saturday, June 28, 2025 1p.m.-3p.m., Saturday July 26, 2025 1p.m.-3p.m., and  Saturday, August 23, 2025 1p.m.-3p.m., all qualifiers will meet on location at IVP At The Beach House (5910 Omaha Blvd, Colorado Springs, CO 80915.) Qualifiers must be checked in by 2:00 p.m. Qualifiers will be given 1 (one) raffle ticket for each time they’ve been qualified that month, to include their “Xtra Entry(ies)”. X1039 will narrow down the qualifiers to 10 (ten) participants who move on to the final round. The final round is TBD, closer to the giveaway dates. The grand prize winner gets their pick of the two different ticketed shows being offered and cash, and the runner-up receives the pair of tickets not chosen by the Grand Prize winner.

PRIZES: On-Air Treasure Chest Prizes (in no particular order:)  1 pair of tickets to The Colorado Renaissance Festival (ARV $56), 1 pair of tickets to Pikes Peak International Raceway (ARV $120), 2 gift cards to I Heart Mac & Cheese (ARV $20), 1 pair of tickets to the Rocky Mountain Vibes Baseball (ARV $42),  and more prizes to be added!

On-Air “Small Concert Ticket” Prizes (in no particular order:) 1 pair of tickets to Avett Brothers at Red Rocks July 11 (ARV $199), 1 pair of tickets to Punk In The Park July 18 at Western stockyards (ARV $108), with other concert ticket giveaways to be added!

Grand Prize, In-Person “Big Concert Ticket” Prizes: Saturday August 23, 2025. One Pair (2) tickets to see The Offspring OR Weird Al Yankovic AND $700 cash. Runner up gets the tickets the grand prize winner doesn’t pick, and $100 cash. Both Grand Prize and Runner Up winners become ineligible to win X Marks The Spot for the rest of the year. 

ELIGIBILITY: No purchase necessary. To win, you must be 18 years or older and a legal resident of  Colorado. No employee of the X Marks The Spot contest and their affiliated artists and promoters (“Sponsor”) or X1039 (KRXP) (“Station”), their affiliated companies, his or her spouse, or immediate family members and/or those living in the same household of each shall be eligible to win. Immediate family members include, but are not necessarily limited to, parents, brothers, sisters, nieces, nephews, aunts, uncles, cousins, and grandparents. Employees, or relatives of employees, of any television or radio station in the Colorado Springs Nielsen DMA or Colorado Springs Arbitron ADI are not eligible to win. Additionally, Station reserves the right to disqualify any other person from participation in the Contest where such participation would, in the sole opinion of Station, compromise or give the appearance of compromising the integrity of the Contest. No person shall be eligible to win any contest conducted by the Station more than one time in any thirty-day period. Listener will have to requalify each round. If they claimed a tangible treasure chest prize in the round prior, per the 30 day rule, they cannot win another tangible prize, but they will get to hear what was inside. Xtra entries won on air don’t count as a tangible prize. Those who won Xtra entries on air in the prior round will be able to win a treasure chest prize on air.

No responsibility is assumed by X1039, their respective subsidiaries, parents, partners, or other providers for lost, late, misdirected, or illegible entries or for any computer, online, telephone or technical malfunctions that may occur.

MISCELLANEOUS:

1) The winner’s consent to the use of their name, likeness and/or voice without further compensation for Station’s or Sponsor’s advertising, public relations and promotions purposes. By entering Contest, the winner gives Station and Sponsor full rights in perpetuity to broadcast, or distribute their name, likeness and/or voice, in any edited, distorted or altered form executed by Station, in any media including but not limited to broadcast television, radio and the internet, without any further compensation.

2) Station and Sponsor accepts no responsibility or liability for loss or damage due, in whole or in part, to the awarding, acceptance, possession, use or misuse of prize or from participation in the Contest. Winner releases Station and Sponsor, their affiliated companies and employees from any and all liability and claims.

4) From time to time, Station online contests may utilize certain contesting software owned and/or administered by third parties (“Game Administrator”).  In such an event, entrants may be required to have or to establish an account with such Game Administrator but all such accounts shall be free and entry may be limited to one entry per Game Administrator account or limited in any other way announced.  The requirements and limitations on setting up an account will be governed by that Game Administrator and entrants should refer to the Game Administrator’s terms and conditions (for example, a Game Administrator may only require one account per email address).   Game Administrators are not sponsors of Station contests but entrants may be required, as part of the entry process, to agree and consent to their terms of service and/or privacy policy (both of which will be available via a link during the entry or account registration process) (collectively, the “Game Administrator Policies”).  While agreement to the Game Administrator Policies may be required in order to enter a Station contest, the Game Administrator Policies are not a part of these contest rules but are a separate agreement between the entrant and the Game Administrator.  With respect to the conduct of these contests, in the event of any conflict between the Game Administrator Policies and Station contest rules, Station contest rules will govern.

5) Prize is non-transferable and non-assignable. Prize can not be substituted for cash value. Station’s decision with regard to all matters relating to Contest, including those matters not specifically addressed in these rules, shall be final. Checks issued to winners must be cashed or deposited within 60 days of receiving them in the mail, or the winner will forfeit the prize. Prizes not claimed in accordance with these rules will be forfeited and another winner will be selected by another random drawing if deemed necessary.

6) The winner will forfeit prize(s) not claimed within thirty (30) days. 

7) Winners will be notified on the phone, or in person at one of the live events. Do not come to the station unless instructed to do so.

8) Void where prohibited.

9) Release. By participating, each participant and winner waives any and all claims of liability against The Sponsors their employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in the promotion, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the sponsors.

 

10) Rules. Additions or deletions to these rules are subject to the discretion of the sponsors, and may be enacted without notice at any time during the promotion dates. 

 

11) Taxes. Any valuation of the prize(s) stated above is based on available information provided to the sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All federal/state/local  taxes are winner’s sole responsibility. Insurance coverage, registration and title transfer fee are also the winner’s sole responsibility. Winners must provide the sponsors with valid identification and a valid social security number before

any prize will be awarded. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

 

12) X1039 will not be responsible for prizes not delivered by participating clients as a result of “going out of business” or any other reason.

 

13) Decisions. By participating in the promotion, participants agree to be bound by the decisions of the sponsors. The sponsors reserve the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible, violated any rule or provided false information. If the conduct or outcome of the promotion is affected by human error, any mechanical or technical errors, malfunctions or failures of any kind, or any event beyond the control of the sponsors. The sponsors reserves the right to terminate this promotion or make such other decisions regarding the outcome as the sponsors deems appropriate. All decisions will be made by the sponsors and are final. 

 

14) Miscellaneous. Each winner must submit proof of eligibility and sign The Sponsor’s release form to claim the prize. No purchase necessary to participate or win. Void where prohibited. The Sponsors disclaims any responsibility to notify participants of any aspect related to the conduct of the Promotion. Written copies of these rules are available 24/7 on x1039radio.com, and during normal business hours at The Sponsor’s locations and by mail upon written request with a stamped, self-addressed return envelope to:
