1. X1039 (KRXP), Revolution Jewelry Works, The Black Monarch Hotel, Dat’s Italian, Rocky Mountain Chocolate Factory, and Skyway Creations may be referred to “The Sponsors” from this point forward.
2. Dates of Promotion: The promotion begins on 02/03/2025 and ends on 2/14/2025.

• X1039 will promote the event through live liner reads, recorded promos, and our social media pages.
• Starting Monday 02/03/2025 enter to win a Valentine’s Day Prize Pack online at x1039radio.com.  
• On Friday 02/14/2025, we will draw a winner from the entries and announce them on the X1039 Morning Show.
• HOW TO WIN: No purchase necessary. Contestants must visit the contest page on x1039radio.com, complete and submit the entry form to enter. Winner will be randomly chosen and notified via email or phone call after the contest deadline. Contest begins February 3rd, 2025 at 12:00 AM. Deadline for entries is 12:00 AM Friday , February 14th, 2025.

ELIGIBILITY AND LIMITATIONS: No purchase necessary. To win, you must be 18 years or older and a legal resident of Colorado. No employees of either (“The Sponsor(s)”) or KRXP (“Station”), their affiliated companies, his or her spouse, or immediate family members and/or those living in the same household of each shall be eligible to win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, whether as “in-laws” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Employees, or relatives of employees, of any television or radio station in the Colorado Springs Nielsen DMA or Colorado Springs Arbitron ADI are not eligible to win. Additionally, Station reserves the right to disqualify any other person from participation in the Contest where such participation would, in the sole opinion of Station, compromise or give the appearance of compromising the integrity of the Contest. No person shall be eligible to win any contest conducted by the Station more than one time in any thirty-day period. Winner must provide X1039 with his or her social security number, complete a W-9 form if prize is over $600, and must sign an Affidavit of Eligibility and a Release and Waiver from all liability against X1039, its sponsors, employees and affiliated companies for any injury or loss which may occur from the contestant’s participation in the contest or from use of any prize which is awarded. One winner per household per 30 thirty days. 

No responsibility is assumed by KRXP, their respective subsidiaries, parents, partners, or other providers for lost, late, misdirected, or illegible entries or for any computer, online, telephone or technical malfunctions that may occur.

MISCELLANEOUS:

1) The winner’s consent to the use of their name, likeness and/or voice without further compensation for Station’s or Sponsor’s advertising, public relations and promotions purposes. By entering Contest, the winner gives Station and Sponsor full rights in perpetuity to broadcast, or distribute their name, likeness and/or voice, in any edited, distorted or altered form executed by Station, in any media including but not limited to broadcast television, radio and the internet, without any further compensation.

2) Station and Sponsor(s) accept(s) no responsibility or liability for loss or damage due, in whole or in part, to the awarding, acceptance, possession, use or misuse of prize or from participation in the Contest. Winner releases Station and Sponsor, their affiliated companies and employees from any and all liability and claims.

3) Prize is non-transferable and non-assignable. Prize can not be substituted for cash value. Station’s decision with regard to all matters relating to Contest, including those matters not specifically addressed in these rules, shall be final. Prizes not claimed in accordance with these rules will be forfeited and another winner will be selected by another random drawing.

4) Publicity; Privacy. By participating, all participants and winner(s) grant The Sponsors and its promotional partners exclusive permission to use their names, characters, photographs, voices and likenesses in connection with promotion of this and other Promotions and waive any claims to royalty, right or remuneration for such use. By participating in the Promotion, participants agree that The Sponsors may disclose personal information obtained from participants in the Promotion to third parties and use such information for marketing and other purposes.
Release.  By participating, each participant and winner waives any and all claims of liability against The Sponsors, their employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the promotion, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the sponsors.
Rules. Additions or deletions to these rules are subject to the discretion of the sponsors, and may be enacted without notice at any time during the promotion dates.

5) If winner is unable to meet the above criteria stated in rules 6-9, then he or she will become ineligible to qualify or win the grand prize and a runner-up will be selected.
The winner will forfeit all prizes not claimed within thirty (30) days.

6) Taxes. Any valuation of the prize(s) stated above is based on available information provided to the sponsors, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All federal/state/local taxes are winner’s sole responsibility. Insurance coverage, registration and title transfer fee are also the winner’s sole responsibility. Winners must provide the sponsors with valid identification and a valid social security number before any prize will be awarded. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

7) X1039 will not be responsible for prizes not delivered by participating clients as a result of “going out of business” or any other reason.
Decisions. By participating in the promotion, participants agree to be bound by the decisions of the sponsors. The sponsors reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible, violated any rule or provided false information. If the conduct or outcome of the promotion is affected by human error, any mechanical or technical errors, malfunctions or failures of any kind, or any event beyond the control of the sponsors. The sponsors reserves the right to terminate this promotion or make such other decisions regarding the outcome as the sponsors deems appropriate. All decisions will be made by the sponsors and are final.

8) Each winner must submit proof of eligibility and sign The Sponsor’s release form to claim the prize. No purchase necessary to participate or win. Void where prohibited. The Sponsors disclaims any responsibility to notify participants of any aspect related to the conduct of the Promotion. Written copies of these rules are available 24/7 on X1039radio.com, and during normal business hours at The Sponsors locations and by mail upon written request with a stamped, self-addressed return envelope to X1039, 1805 E. WINNER UNDERSTANDS AND AGREES THAT HE OR SHE IS RESPONSIBLE FOR ALL APPLICABLE TAXES INCURRED ON PRIZES RECEIVED.

9) Apple is not a sponsor or involved in the activity of the contest in any manner.

10) Facebook & Instagram are not sponsors or involved in the activity of the contest in any manner.

11) Winners will be notified by phone call or email no later than 5 PM Friday, February 09, 2024. Winner must claim prize within 30 days. Do not come to the Station unless instructed to do so.
